HOA Approval
Your right to fence
HOAs Can't Ban Perimeter Fences
Texas Property Code §202.023 stops an HOA from banning a perimeter fence used for security. The HOA can still regulate the fence type.
Read the lawFront yards · SB 711
New Limits Since September 1, 2025
HOA covenants can prohibit fences in front of the house's front building line and fences that block sidewalks or drainage, and can require driveway gates set back 10 feet. Fences built before that date can stay and be maintained.

The HOA Has to Explain a Denial
For HOAs with more than 40 lots, §209.00505 requires a denial to give the reasons and the changes needed. You can ask for a board hearing within 30 days. The law sets no decision deadline. That comes from your HOA's own requirements.
